Claim Substantiation at NAD and the Role of the ASTM Guide

Mallen.jpgDavid Mallen focuses his practice in the areas of advertising and consumer protection law. He represents marketers from a variety of industries in connection with national advertising campaigns, analysis of claim substantiation, regulatory issues, and resolution of advertising disputes. David is an experienced trial lawyer with expertise representing clients in all phases of litigation in state and federal court and in alternative dispute resolution. As the former Deputy Director of the National Advertising Division (NAD) of the Council of Better Business Bureaus, David has extensive experience with industry self-regulation, and he represents advertisers in defending and challenging advertising claims before NAD and other tribunals.

David provides legal guidance on the advertising of food and beverages, OTC drugs, telecommunication services, consumer household products, dietary supplements, cosmetics, and information technology. In addition to representing clients on these issues, he is also a popular speaker and lecturer at conferences and workshops on advertising claim substantiation, U.S. standards for industry self-regulation, sustainability and green marketing, and scientific sensory testing. David is a vice chair of the ABA’s Advertising Disputes and Litigation Committee. He is the co-author of How to Make Credible Green Marketing Claims: What Marketers Need to Know about the Updated FTC Green Guides, published by AdAge in 2013.
